Trusec.ai Pty Ltd (ABN 44 702 224 155), based in Victoria, Australia, operates this website. “We”, “us” and “our” refer to that company.

By using the website or fit check, you agree to these terms. You must be authorised to act for any organisation you represent. If you do not agree, do not use the site.

This is a business service for users aged 18 or over who can legally agree to these terms. Provide accurate information and do not impersonate others.

Website content and fit-check results provide general information and preliminary scope guidance, not an assessment, certification, legal advice or assurance. Do not rely on them alone for deployment, procurement, compliance or risk decisions.

Paid assessments are governed by the assessment terms accepted for the order and any signed order form or negotiated agreement. That agreement takes precedence over these website terms for the paid service.

You have a limited, revocable, non-exclusive right to use the site to evaluate our services lawfully. You must not:

• break any law or infringe another person’s rights;
• access information without authorisation or bypass security controls;
• introduce malware, disrupt or overload the service;
• scrape, copy or reverse engineer the site except where applicable law does not permit that restriction; or
• conduct security testing without prior written coordination.

Protect your account and access links. You are responsible for account activity; report suspected unauthorised access promptly. Share access only with authorised members of your organisation.

Do not send secrets, credentials, live-system access or sensitive customer data through the public site or initial email. Follow the additional intake instructions.

We own or license the site and its content. No ownership transfers to you. You may make reasonable internal copies of public material to evaluate our services or support procurement.

Customer material remains subject to customer rights and the assessment agreement. We may use feedback without identifying you or disclosing your confidential information.

Independent third-party services have their own terms and privacy notices. Linking to a site does not endorse its content or practices.

We may change, suspend or withdraw public-site features. We do not promise uninterrupted or error-free availability or suitability for every purpose. Later website terms do not change an accepted paid-assessment agreement.

To the maximum extent permitted by law, the public site and fit check are provided as available and without warranties beyond those expressly stated. Nothing in these Website Terms excludes, restricts or modifies a guarantee, right or remedy that cannot lawfully be excluded, including rights that may apply under the Australian Consumer Law or mandatory UK or US law.

Where a non-excludable guarantee applies and the law permits limitation, our responsibility is limited to the remedy permitted by that law. Rights and remedies for a paid assessment are addressed in the applicable assessment agreement.

To the maximum extent permitted by law, we are not liable for indirect, incidental or consequential loss arising solely from use of, or inability to use, the free public site or a preliminary fit-check result. This does not limit liability that cannot lawfully be limited, including liability for fraud, wilful misconduct, or death or personal injury caused by negligence where the applicable law prohibits exclusion.

These Website Terms are governed by the laws of Victoria, Australia. You and trusec.ai submit to the non-exclusive jurisdiction of the courts of Victoria and courts entitled to hear appeals from them. This clause does not deprive you of protections under mandatory laws that apply regardless of that choice.

Before formal proceedings, each party should give written notice and a reasonable opportunity to resolve the issue, unless urgent relief is needed.

Updates apply prospectively from the effective date shown above. We give additional notice of material changes where required by law.
