Website terms of use.

This website is operated by Trusec.ai Pty Ltd (ABN 44 702 224 155), an Australian private company based in Victoria, Australia. “trusec.ai”, “we”, “us” and “our” refer to that company.

By accessing or using this website or the public fit check, you agree to these Website Terms. If you use the site for an organisation, you confirm that you are authorised to act for it. If you do not agree, do not use the site.

trusec.ai is designed for organisations and their authorised professional users. You must be at least 18 years old and legally capable of agreeing to these Website Terms. You must provide accurate information and must not impersonate another person or organisation.

Public content and fit-check results are general information and preliminary scope guidance. They are not a security assessment, penetration test, code review, certification, legal opinion, regulatory determination or assurance sign-off. Do not rely on them as the sole basis for a deployment, procurement, compliance or risk-acceptance decision.

A paid assessment is governed by the assessment terms accepted for that order, together with any signed order form or negotiated agreement. If those terms conflict with these Website Terms for a paid service, the assessment agreement controls.

We grant you a limited, revocable, non-exclusive right to use the public site for lawful evaluation of trusec.ai and its services. You must not:

• break any law or infringe another person’s rights;
• attempt to access another customer’s account, assessment or report;
• bypass authentication, rate limits or other protective controls;
• introduce malware, disrupt the service or overload its infrastructure;
• scrape, copy or reverse engineer the site except where applicable law does not permit that restriction; or
• conduct security testing without prior written coordination through the process described on our Security page.

You are responsible for activity performed through your account and for protecting its authentication methods. Tell us promptly if you suspect unauthorised access. Secure links are issued for an intended recipient and must not be published or shared outside authorised members of the relevant organisation.

Do not provide secrets, credentials, live-system access or sensitive customer datasets through the public site or initial email. Assessment submissions are subject to the additional boundaries shown during intake.

The site, its design, software, text, graphics, methodology descriptions and trusec.ai branding are owned by or licensed to us and are protected by applicable intellectual-property laws. No ownership transfers under these Website Terms. You may make reasonable internal copies of public material solely to evaluate trusec.ai or support procurement.

Customer-submitted material remains subject to the customer’s rights and the applicable assessment agreement. If you provide feedback, you permit us to use it without identifying you or disclosing your confidential information.

The site uses or links to third-party services, including identity and payment providers. Their own terms and privacy notices govern their independent services. A link does not mean that trusec.ai endorses every statement, product or practice on the linked site.

We may maintain, change, suspend or withdraw public-site functionality. We do not promise that the public site will be uninterrupted, error-free or suitable for every purpose. We will not deliberately alter an accepted paid-assessment agreement through a later change to these Website Terms.

To the maximum extent permitted by law, the public site and fit check are provided as available and without warranties beyond those expressly stated. Nothing in these Website Terms excludes, restricts or modifies a guarantee, right or remedy that cannot lawfully be excluded, including rights that may apply under the Australian Consumer Law or mandatory UK or US law.

Where a non-excludable guarantee applies and the law permits limitation, our responsibility is limited to the remedy permitted by that law. Rights and remedies for a paid assessment are addressed in the applicable assessment agreement.

To the maximum extent permitted by law, we are not liable for indirect, incidental or consequential loss arising solely from use of, or inability to use, the free public site or a preliminary fit-check result. This does not limit liability that cannot lawfully be limited, including liability for fraud, wilful misconduct, or death or personal injury caused by negligence where the applicable law prohibits exclusion.

These Website Terms are governed by the laws of Victoria, Australia. You and trusec.ai submit to the non-exclusive jurisdiction of the courts of Victoria and courts entitled to hear appeals from them. This clause does not deprive you of protections under mandatory laws that apply regardless of that choice.

Before starting formal proceedings, each party should give the other written notice of the issue and a reasonable opportunity to resolve it, unless urgent relief is required.

We may update these Website Terms prospectively. The effective date above will show when they changed. Material changes will receive additional notice where required by law.
